Beyond Kenya Safaris – Terms & Conditions

Welcome to Beyond Kenya Safaris. By requesting or confirming travel services with us, you acknowledge that you have read, understood, and agreed to the following Terms and Conditions. These Terms apply to all itineraries, quotations, and bookings arranged by Beyond Kenya Safaris (“the Company”).
1. Scope of Services
Beyond Kenya Safaris specializes in designing tailor-made safaris, accommodation arrangements, and travel logistics across East Africa.
Our services include itinerary design, supplier coordination, bookings, and travel consultation based on your preferences and budget.
2. Planning & Consultation Fee
To begin itinerary preparation, a non-refundable planning and consultation fee is required.
This fee covers the professional time, research, and communication involved in crafting your personalized safari proposal.
If you proceed to book your safari through Beyond Kenya Safaris, the planning fee will be credited toward the final safari cost.
This fee confirms your genuine travel intent and allows us to allocate dedicated time and resources to your itinerary.
3. Planning / Consultation Fee
To initiate itinerary preparation, a non-refundable planning and consultation fee ranging from US$ 250 to US$ 1,000 is required, depending on the level of accommodation selected and the mode of local transfer (scheduled flights or private road transfers).
This fee covers:
- Professional time spent designing and customizing your itinerary.
- Administrative and communication costs with lodges, camps, and other suppliers.
- Research and expert advisory services rendered prior to formal booking.
If the Client proceeds to confirm and book the safari through Beyond Kenya Safaris, this planning fee will be credited toward the final safari cost.
4. Booking Confirmation and Payments
Once you approve a proposed itinerary and quotation:
- A 30% deposit of the total trip cost is required to secure bookings.
- The balance must be paid no later than 45 days before arrival.
- All payments must be made in the business name Beyond Kenya Safaris via bank transfer, or other approved payment methods.
Failure to make timely payments may result in cancellation of bookings, subject to supplier penalties.
5. Cancellations and Refund Policy
a) Before Booking Confirmation
If you choose not to proceed with a proposed safari after an itinerary has been prepared, the planning fee will remain non-refundable as compensation for professional time and costs already incurred.
b) After Booking Confirmation
If you cancel after your trip has been confirmed and deposits made, cancellation charges will apply according to the policies of the individual lodges, camps, airlines, or service providers involved.
Beyond Kenya Safaris will make every effort to minimize penalties where possible, but supplier terms will take precedence.
6. Client Responsibilities
Clients are responsible for:
- Providing accurate travel information and names as per passports.
- Reviewing all travel documents and confirmations issued by Beyond Kenya Safaris.
- Obtaining valid passports, visas, and travel insurance prior to departure.
- Informing the Company of any medical or dietary requirements in advance.
The Company shall not be liable for costs or losses resulting from incorrect information provided by the Client.
7. Travel Insurance
Comprehensive travel insurance is strongly recommended to cover trip cancellation, medical expenses, lost luggage, and other unforeseen circumstances.
Beyond Kenya Safaris does not provide insurance but can assist with guidance on suitable policies.
8. Liability & Force Majeure
Beyond Kenya Safaris acts only as an agent for hotels, lodges, transport companies, and other service providers.
We are not liable for injury, loss, delay, or damage caused by acts of nature, war, government restrictions, civil disturbances, weather conditions, or any circumstances beyond our control.
In the event of such circumstances (“Force Majeure”), Beyond Kenya Safaris will make reasonable efforts to reschedule or adjust arrangements but cannot guarantee refunds beyond those offered by suppliers.
9. Currency & Pricing
All prices are quoted in U.S. Dollars (USD) unless otherwise stated.
Prices are subject to change due to supplier adjustments, currency fluctuations, park fees, or government taxes. Clients will be notified in writing of any significant changes before confirmation.
10. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Kenya and, where applicable, the laws of the United States (State of [All States) for U.S.-based transactions.
Any disputes arising shall be resolved amicably; failing that, they may be submitted to arbitration in Nairobi, Kenya.
