🕐 Arrival and Check-Out Times

🕛 Check-in — Rooms are available for new arrivals from 12 noon on the date of arrival

🕙 Check-out — Rooms should be vacated by 10:00 a.m. on the date of departure

Special considerations may be made for extended departure time subject to availability.

📝 Booking Policy

📄 Official Booking Voucher Required — Any Agent must send an official booking voucher for the booking to be reserved. Telephone inquiries do not guarantee reservation of bookings.

💰 Deposit — A deposit payment does not prove that the reservation is confirmed and is not entitled to a confirmation voucher.

⭐ Peak Season Priority — At Mara Simba Lodge, priority will be accorded to bookings staying in at least one (1) other Simba Lodges property.

📦 Block Bookings

⚠️ Right to Review — Simba Lodges reserves the right to review, stop sale or reduce the number of rooms held in a block at any point in time.

🚫 Automatic Release — In the event that the Agent does not issue a booking voucher before the expiry of the relevant block release period, such rooms shall automatically be removed from the Allotment and released by Simba Lodges.

📅 Provisional Bookings

📧 Request via Email — Simba Lodge may receive a request via email to hold bookings provisionally

⚠️ Right to Request Release — Reserves the right to ask the Agent to release the booking or request for a 50% deposit for any booking at any point in time

📈 High Demand Periods — During periods of high demand, Simba Lodges reserves the right to shorten the provisional booking expiry period or to not take any provisional bookings

💳 Payment Policy

📈 Late Payment	20% interest if invoice not paid within agreed time period
⚖️ Collection Fees	Agent agrees to pay all fees including Court Costs, Legal Fees, and other expenses

The rates stated in this contract are not to be used for conferencing. Kindly contact sales@simbalodges.com for conferencing, events and team building requests.

🔄 Refunds

In the event clients arrive late or request for an early departure, no refund or compensation will be granted.

📊 Over Bookings

Simba Lodges shall provide the rooms booked. In the event that Simba Lodges is not able to meet its obligations under this Agreement for any reason whatsoever, Simba Lodges shall promptly notify the Agent with the option of a re-route or an alternative accommodation of similar standard.

Whilst Simba Lodges will ensure that all anticipated accommodation will be available as planned, there shall be no claim of any nature against Simba Lodges for a refund (either in part or whole), if any accommodation is unavailable and a reasonable alternative was found — or if guests were unable to make use of the services for any reason.

🛡️ Insurance

The Agent must ensure that their clients have a comprehensive insurance cover for their itinerary and for medical expenses, emergency evacuation, cancellation, personal belongings and money.

⚖️ Liability

Simba Lodges does not accept responsibility for any incident of any nature involving any client who is/are at any property(ies), nor while travelling to or from any property(ies).

📌 Applicability

This contract is valid for non-residents only and for leisure business only. Proof of residency and identification are required upon check-in. These rates are not to be used for onward distribution to any Third parties, on-line travel/hotel booking websites.

🔄 Variation

In the event of a change in exchange rates or any government taxes/levies, Simba Lodges reserves the right to adjust the rates of this Agreement accordingly without prior notice.

🌪️ Force Majeure

Simba Lodges will not be held liable to the Agent or its clients for unfulfilled accommodation, services or contractual obligations that result from Force Majeure or any circumstances beyond control of Simba Lodges.

Such occurrences include cases of war, acts of terrorism, insurrection, political upheaval, labour disputes, strikes, laws or regulations, boycotts, epidemics, natural disasters, contagious diseases or other circumstances of any kind or nature that unfavourably affect the operations at Simba Lodges.

🔒 Data Protection

Simba Lodges and the Agent will adhere to Kenya data protection legislation, including the Data Protection Act of 2019 and, where applicable, the General Data Protection Regulation (EU) 2016/679 (“Data Protection Legislation”).

Simba Lodges and the Agent will ensure they have the necessary consents and notices for lawful transfer of personal data under this Agreement. Simba Lodges will implement appropriate technical and organizational measures to prevent unauthorized processing, loss, or damage to personal data.

The Agent shall indemnify Simba Lodges against all claims and proceedings and all liability, loss, costs and expenses resulting from the breach of Data Protection Legislation by the Agent, its employees, or its agents.
